WANDER WOMEN IOWA TRIP RELEASE

Please read this agreement carefully. It contains important information about the activities (sometimes referred to in this agreement as “Trips”) of Wander Women Iowa, LLC, a Iowa limited liability company doing business as, and sometimes referred to in this agreement as, “Wander Women Iowa.” In addition, the agreement seeks protection from claims arising from those activities. Everyone enrolled in or otherwise participating in Wander Women Iowa activities must sign this agreement (including without limitation volunteers, trips leaders, independent contractors or otherwise).  Questions should be directed to hello@wanderwomeniowa.com , and further information is available at www.wanderwomeniowa.com.

In consideration of the services of Wander Women Iowa, I acknowledge and agree as follows:

ACTIVITIES AND TRIPS

Wander Women Iowa brings groups of women together for weekend trips in the outdoors, including camping, hiking, backpacking, kayaking, fire-building, cooking and other traditional low impact outdoor activities. Participation requires moderately good health and physical conditioning. Trips are generally of two and three days’ duration.

Transportation: To better achieve the goals of the Trips, Wander Women Iowa may assist in forming carpools to and from activity sites for each Trip but is not responsible for accidents or other events occurring during such transportation. A participant who chooses to drive her own motor vehicle to or from any activity sites for each Trip is responsible for the safety and security of the vehicle and its passengers. Wander Women Iowa accepts no responsibility for the drivers or passengers, or their personal property, and carries no insurance for losses incurred.

RISKS

Participants will be exposed to a variety of hazards and risks, foreseen and  unforeseen, which include, among others, the following: travel to and from the activity site by auto or van, which may be driven by staff or a fellow participant; hiking over uneven terrain, exposed to rock fall, falling timber and the unpredictable forces of nature, and to plants and animals which may be dangerous; traveling over large and moving bodies of water, and the possibility of cold water immersion and even drowning; trips and falls, burns and cuts, and sicknesses associated with camping activities and moving about in remotes areas; carelessness of other participants, members of the Wander Women Iowa staff, volunteers, and independent contractors who may provide certain services. Trips may be conducted in remote places, and rescue and emergency medical care may be significantly delayed.  

These and other risks are inherent in the activities: that is, they cannot be eliminated without destroying the unique value and character of the trip. These and other risks may cause property damages, serious personal injury and even death.

ASSUMPTION OF RISKS

I understand the risks described above and that other risks will be encountered.  I willingly assume all risks arising from my enrollment and participation in activities, including Trips, of Wander Women Iowa, inherent and not and whether or not described above.

AGREEMENTS OF RELEASE AND INDEMNITY

To the fullest extent allowed by law, I agree, for myself and my personal representatives, heirs, and family members, to waive and release from liability and not to sue Wander Women Iowa, LLC, its members, owners, officers, directors, employees, agents, leaders and drivers of personal vehicles to and from the activity site (the “Released Parties”) with respect to any liability for injuries and damages suffered by me, even if caused by the negligence of a Released Party, in any way related to my being enrolled in, whether or not actively participating in, activities, including travel, of Wander Women Iowa. I further agree to defend, indemnify and protect  Wander Women Iowa, LLC and the other Released Parties from all claims, damages, injuries and losses caused to others by my own acts or omissions while enrolled or participating in the activities of Wander Women Iowa.

OTHER

I have read all rules and conditions applicable to the Trip made available to me; I will pay all costs and fees for the Trip; and I acknowledge my enrollment and participation is at the discretion of Wander Women Iowa.

I authorize Wander Women Iowa to perform or obtain for me such emergency medical care as its staff deems necessary and I will pay for all related expenses of that care, including travel. Wander Women Iowa may, without compensation, take and use photo images of me it deems appropriate, including for promotional purposes.

Persons who leave the trip before completion, choose to spend time apart from group, or continue independently after the conclusion of the trip assume all risks of such deviations from the trip and waive and release all claims the Released Parties, as provided above.

THIS AGREEMENT AND ALL OTHER ASPECTS OF MY RELATIONSHIP WITH WANDER WOMEN IOWA IS GOVERNED BY IOWA STATE LAW EXCEPT THOSE LAWS WHICH MAY INVOKE THE LAWS OF ANOTHER STATE. FURTHER, ANY MEDIATION, SUIT, OR OTHER PROCEEDING ARISING OUT OF OR RELATING TO MY ENROLLMENT OR PARTICIPATION IN WANDER WOMEN IOWA’S ACTIVITIES MUST BE FILED OR ENTERED INTO AND MAINTAINED ONLY IN THE STATE OF IOWA, POLK COUNTY. IF A DISPUTE CANNOT BE RESOLVED BY PRIVATE NEGOTIATION, I AGREE TO ATTEMPT TO SETTLE IT THROUGH MEDIATION BEFORE A MUTUALLY ACCEPTABLE MEDIATOR BEFORE PURSUING LITIGATION.

THIS AGREEMENT IS INTENDED TO BE AS BROAD AND INCLUSIVE AS IS PERMITTED BY LAW. IF ANY PART OF THIS AGREEMENT IS HELD TO BE INVALID OR LEGALLY UNENFORCEABLE FOR ANY REASON BY A COURT OF COMPETENT JURISDICTION, THE REMAINDER OF THIS AGREEMENT SHALL NOT BE AFFECTED THEREBY AND SHALL REMAIN VALID AND FULLY ENFORCEABLE.

THIS AGREEMENT PERTAINS TO ALL WANDER WOMEN IOWA TRIPS ON OR AFTER THE DATE OF ITS EXECUTION, UNLESS AND UNTIL THE PARTICIPANT SIGNS ANOTHER TRIP AGREEMENT PERTAINING TO TRIPS THEREAFTER.
